By subscribing to Kaeru CRM Advantage or Advantage Plus, provided by Kaeru CX, you agree to the following Terms and Conditions.
Platform Note: Kaeru CRM Advantage and Advantage Plus are built using the Go High Level platform. While Kaeru CX ensures a high-performing and reliable service, occasional downtime or service interruptions may occur due to issues on the Go High Level infrastructure, which are outside our direct control. In such cases, Kaeru CX will work diligently with Go High Level to resolve any disruptions as quickly as possible. Kaeru CX is not liable for any losses or damages resulting from such interruptions.
Kaeru CRM Advantage and Advantage Plus are offered on a flexible month-to-month or annual basis. There is no long-term commitment required, and you may cancel your subscription at any time.
Free Trial: A 14-day free trial is provided upon registration. At the end of the trial, your selected monthly or annual billing plan will begin automatically unless canceled prior to the trial’s conclusion.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You will be charged at the rates in effect at the time of renewal.
Sales Tax: Subscription fees may be subject to applicable state and local sales tax based on your billing address and current tax laws.
No Refunds: All fees paid, including subscription payments and setup fees, are non-refundable. No refunds are provided for cancellations made before the end of a billing cycle.
Late Payments: Failure to make timely payments will result in service suspension. If payment is not received within 30 days, Kaeru CX reserves the right to terminate your subscription and access.
You may cancel your subscription at any time via your account settings or by contacting support. Access will continue through the end of your current billing cycle.
If you choose to transfer your Kaeru CRM Advantage or Advantage Plus system directly to Go High Level, Kaeru CX can assist in the transition. A one-time transfer fee of up to $2,500 will apply. This fee does not include the cost of automation migration, CRM configuration, data review, or any consulting hours related to transition. Kaeru CX will not be held responsible for delays, service disruptions, or any lost or missed data resulting from the transfer process.
All phone, text, email, and feature-related usage beyond included services will be billed at the following standard usage rates:

Note: All usage fees listed above are subject to change at any time due to increases in provider or carrier costs. Material changes will be communicated whenever possible.
Your Data: All customer data, contact lists, and communications uploaded by you remain your property. Kaeru CX will only access or use your data to deliver agreed-upon services.
Compliance: You are responsible for complying with all applicable privacy regulations, including consent for marketing communications via SMS or email.
Kaeru CX may update pricing, features, or service terms. Notifications will be provided 30 days in advance where legally required.
You agree to follow all laws governing electronic communication, including the CAN-SPAM Act, TCPA, and any applicable state laws.
Kaeru CX is not liable for indirect or consequential damages arising from use or disruption of the CRM platform. Service interruptions may occur due to third-party systems or infrastructure.
Support is provided via email and in-app messaging. Your subscription includes updates for system bugs or broken workflows. Additional automation work may require a separate consulting or service agreement.
Kaeru CRM Advantage does not limit the number of contacts stored. However, you will be notified if your account activity exceeds normal platform use or triggers system performance issues.
This agreement is governed by the laws of the state of New Jersey. Any disputes will be handled in the courts of that state.
Kaeru CX complies with all applicable state and federal consumer protection laws. You may be entitled to additional rights depending on your state of residence.
Any disputes will be resolved via binding arbitration, with both parties waiving rights to class action claims unless prohibited by law.
Chargebacks may result in service suspension or termination. If you believe a charge is in error, contact Kaeru CX before initiating a chargeback.
Kaeru CRM Suite is committed to protecting the privacy of the data relating to our users, and their clients. We will collect, store, use and protect any personal information that you share with us. We will not share your information with anyone, except as described in this Privacy Policy.
Throughout this Privacy Policy, we will refer to our website, applications delivered via the web, and other related services collectively as the “Service.”

We employ the highest in industry standards to protect Personally Identifiable Information, as well as any information provided relating to your invoiced customers.
Third-party client and customer information, provided to Kaeru CRM Suite by users, shall be considered confidential and shall not be disclosed to any third party, unless required to do so by law or subpoena or if we believe that such action is necessary to conform to the law, or comply with legal process served on us. Such information shall be utilized only for the purpose for which Kaeru CRM Suite was created, which is to facilitate the billing and collection process for electronic billing of customers and clients.
Although Kaeru CRM Suite utilizes the highest reasonable levels of data security in the industry, we cannot guarantee the security of PII or other information provided to us. By using our Website, you acknowledge and agree that we make no such guarantee, and that you use our Website at your own risk.
Kaeru CRM Suite will not rent or sell your Personal Information to others. We may store personal information in locations outside the direct control of Kaeru CRM Suite (for instance, on servers or databases co-located with hosting providers). Kaeru CRM Suite will share your Personal Information with a limited number of Kaeru CRM Suite partners for the explicit purpose of providing services to you.
